Classification of Goods and Services

The International Classification of Goods and Services for Trade Mark Registration, also known as the International (Nice) Classification of Goods and Services, is provided by the World Intellectual Property Organization (WIPO) and divides goods and services into 45 categories to distinguish the scope of trade mark application. This classification is updated every 5 years. The international classification of goods and services for trade mark registration was established in accordance with the Nice Agreement signed in Nice, France in 1957. Among the 45 categories, 1-34 is the classification of goods and 35-45 is the classification of services. Since many countries accept the international classification of goods and services for trade mark registration, the establishment of this classification makes the registration of trade marks more efficient.

Trade Mark classification:

Word mark

Refers to trade marks consisting only of characters, including Chinese characters and minority characters, foreign characters and Arabic numerals or combinations of different characters.

Graphic trade mark

Refers to trade marks that consist only of graphics, which can be divided into:

1. Marked trade mark: refers to a trade mark that uses simple symbols to form a pattern;

2. Geometric figure trade mark: a trade mark composed of more abstract figures;

3. Natural graphic trade mark: a graphic trade mark that is composed of people, animals, plants, natural scenery and other natural objects. Some are made of physical photos, while others are trade marks formed by natural graphics that have been processed through refining, summarizing and exaggeration.

Letter Trade Mark

Refers to the smallest writing unit using pinyin text or phonetic symbols, including trade marks composed of pinyin text, foreign letters such as English letters, Latin letters, etc.

Digital trade mark

Trade marks composed of Arabic numerals, Roman numerals, or Chinese uppercase numerals.

Three-dimensional logo trade mark

Also known as a three-dimensional trade mark, it is a trade mark with three dimensions of length, width and height. They are different from the trade mark patterns we usually see on single plane, and appears in a three-dimensional material form. This form may appear in the shape of the product, or on the container or other parts of the product. This is a new addition to the newly revised “Trade Mark Law” in 2001, which will make China’s trade mark protection system more complete.

Colour combination trade mark

A colour combination trade mark refers to a trade mark formed by two or more colour arrangements and combinations. Trade Marks composed of characters, patterns and colours are not colour combination trade marks, but general combination trade marks.

Overall portfolio trade mark

Refers to a trade mark consisting of a combination of two or more components, also known as a composite trade mark.

Sound mark

A set of music composed of musical notes or a trade mark with a special sound as a product or service is a sound trade mark. For example, a record company in the United States used 11 notes to compose a set of music, and it was cast at the beginning of the audiotapes it sold as a mark to identify its goods. This company applied for trade mark registration in order to protect the exclusive rights of the sound, and prevent others from using or copying it. Sound trade marks are currently only recognized in a few countries such as the United States.

Scent trade mark

The scent trade mark is a trade mark that distinguishes different goods and different service items with a special smell. At present, such trade marks are only recognized as trade marks in individual countries. It cannot be registered as a trade mark in China.
