Registering a trade mark in Singapore
A trade mark is a mark used to distinguish the brand or service of one operator from the goods or services of other operators. A trade mark protects the trade mark holder by securing the exclusive right to use it to identify goods or services or to license others to use it for compensation.

Singapore’s Trade Marks Act was enacted in 1998 and has been in force since January 1999. Singapore is a member of the World Trade Organization (WTO) and joined WIPO in 1990, the Paris Convention in 1995 and the Protocol to the Madrid Agreement in 2000.

In Singapore, an applicant must apply through the Intellectual Property Office of Singapore (IPOS) to obtain registration of a trade mark and obtain legal protection. The Trade Mark Registry at the Intellectual Property Office of Singapore (IPOS) is the only office that handles trade mark applications in Singapore. Generally speaking, the filing cycle for a trade mark application in Singapore is 4 to 6 months.

Singapore Trade Mark Framework
1. Conditions for application: Natural or legal persons may apply for trade marks. Natural persons must attach a copy of their passport or ID card, and legal persons must attach a copy of their business license. There are no restrictions on nationality. 2. The constituent elements of a trade mark are words, letters, numbers, graphics or pictures, emblems, colours or combinations of colours, the shape of a container or external packaging of the goods (which cannot be shaped merely to obtain a certain function), and combinations of the above elements. Singapore also accepts non-visual trade marks such as sound, taste and smell trade marks. 3. Classes and Types of Trade Marks Singapore classifies trade marks for registration under the International Nice Agreement, which contains 34 classes of goods and 11 classes of services. An applicant may apply for registration of a particular class or classes of goods or services together, depending on the company’s business and the class or classes of trade marks/services it wishes to protect.4. The priority of use and the right holder is identified by the original documentary evidence of the trade mark.
5. Duration of registration of trade marks. The registered trade mark is valid for 10 years from the date of application. If the registered trade mark needs to continue to be used after the expiration date, the holder should apply for renewal of registration within 6 months of the expiration date, and the validity period of each renewal registration is 10 years.
Documents required for trade mark registration in Singapore

2. 6 copies of the trade mark design if the proposed registration is in colour or only one copy of the proposed registration is in black and white.
3. Provide a list of products or services to be registered and the type of registration.

Singapore Trade Mark Registration Procedure

1. The applicant (or his agent) submits the application form to the Trade Mark Registrar, together with the payment of the prescribed fee.

2. Upon receipt of the application form, the Trade Marks Registry will examine the application to ensure that it complies with the relevant provisions of the Trade Marks Ordinance. If it is found that the application does not comply with the Trade Marks Ordinance, the Trade Marks Registry will issue a report stating the reasons why the trade mark cannot be registered.

3. If the registration of the trade mark is examined and the application is found to be in order, a notice of the registration of the trade mark is published in the Government Gazette

4. Any person may oppose the registration of the trade mark within two months of the publication of the notice. If no opposition is received, the Trade Marks Registry will proceed with the registration.

5. Finally, the Trade Marks Registry issues a certificate of registration to the applicant.
